Tonico Health & Performance - Gym and services Terms & Conditions
Effective Date: 5 August 2025
These Terms & Conditions govern membership at Tonico Health & Performance, operated by Nice and Solid Ltd (the “Company”). By entering the premises or purchasing a membership, each individual (“Member”) agrees to be bound by the following terms, as amended from time to time. Tonico Health & Performance (the “Club”) is committed to providing an inclusive, respectful, and high-standard environment for all individuals, irrespective of race, gender, age, marital status, disability, religion, national origin, or sexual orientation.
1. Membership Structure and Eligibility
Membership is open to individuals aged 18 and over. Persons aged 14–17 may be admitted provided they train exclusively under the supervision of a personal trainer appointed by the Club. Membership may be offered on a monthly or annual basis, or via a single-entry day pass. Fees are as follows:
● Monthly Membership: £150 per calendar month (rolling contract)
● Annual Membership (prepaid): £1,440 (equivalent to £120 per month)
● Day Pass: £50 per visit
Membership is non-refundable and non-transferable. The Club reserves full discretion to approve or decline membership applications and to suspend or terminate memberships where deemed necessary.
2. Billing and Payment Terms
All recurring payments are collected on the 1st day of each calendar month via authorised payment methods, including direct debit, credit/debit card, or third-party processors (e.g., Stripe). Membership fees are reviewed annually and may be subject to adjustment, typically effective from 1 January. Notice of changes will be provided via the Club's website, app, or electronic communication.
3. Default and Collection
Failure to remit payment may result in immediate suspension of access to the Club. If an outstanding balance remains unpaid for more than 30 days, the full balance becomes immediately due. If payment is not made within 15 days following formal demand, the Club reserves the right to terminate the membership and may refer the matter to a third-party collections agency.
4. Cancellation Policy
Cancellations must be submitted in writing via email. A minimum of one full calendar month’s notice is required. Members may cancel within the first month of joining, subject to the same notice period. No refunds are issued for partial months or unused membership following cancellation.
5. Membership Freezes
Members may request a temporary suspension (“freeze”) of their membership for a total of up to 60 days per calendar year, either in a single 60-day period or two 30-day blocks. A minimum of 7 days’ notice is required. Freezes are not retrospective and are limited to two occasions per year. Medical freezes may be granted beyond this allowance upon submission of appropriate documentation from a qualified healthcare provider.
6. Guest Privileges
Each Member is entitled to one complimentary guest pass per calendar month, which is non-cumulative. Guests must be over the age of 18 and must be accompanied by the hosting Member at all times. Guests are subject to all Club rules and policies.
7. Access Control
Access to the Club is granted exclusively via the Tonico Gym mobile application. Entry is not permitted without scanning through the app.
8. Personal Training and Filming
Only authorised Tonico personal trainers may conduct training sessions within the Club. Members may discreetly record themselves using mobile phones, provided no other individuals appear in the frame. The use of tripods or professional equipment is prohibited unless prior written consent has been obtained. Filming or photography is strictly prohibited in changing rooms and other private areas. Video calls are not permitted anywhere on Club premises.
9. Conduct and Behaviour
All Members are expected to behave respectfully and in accordance with the Club’s ethos. The following rules apply at all times:
● No consumption of alcohol or illegal substances
● No outside food; food is not permitted on the gym floor
10. Prohibited Items and Activities
The following are expressly forbidden within the Club:
● Weapons or hazardous objects
● Controlled or illegal substances
● Unauthorised commercial activity or services
● Events, meet-ups, or group sessions without prior authorisation
● Loud personal speakers or audio devices
● Any action jeopardising the safety or well-being of others
11. Gym Floor Etiquette
Members must:
● Wipe down equipment after use
● Re-rack weights and accessories
● Vacate the gym floor at least 20 minutes before closing if intending to shower
12. Lockers and Lost Property
Lockers are available for day use only; contents must be removed after each visit. Lockers are cleared each evening. The Club offers Executive Lockers at £1,000/month. Lost property is retained for up to one month. Perishable or wet items will be discarded after 48 hours.
13. CCTV and Security
Closed Circuit Television (CCTV) is in operation throughout the Club for the safety and security of all members and staff, excluding changing rooms and private areas.
14. Referral Incentive
Members will receive one complimentary personal training session for each new referral who joins the Club and remains a member for a minimum of two months. The following exclusions apply:
● Returning members are not eligible as referrals
● Members joining simultaneously may not refer one another
15. Refunds and Unused Sessions
No refunds will be issued for unused credits, sessions, or memberships following cancellation.
16. Health Declaration and Liability
All Members affirm that they are medically fit to undertake physical activity. If uncertain, they are encouraged to consult a medical professional prior to participation. The Club disclaims liability for any injury or health issue arising from use of its facilities, except where caused by proven negligence. Members engage in all activities at their own risk. Pets are not permitted. Any accident or injury must be reported immediately to a staff member. An emergency contact must be provided upon joining.
17. Service Bookings
Cancellations for personal training or other services (e.g., massage) must be made with at least 24 hours’ notice. Failure to do so will result in full charges. If a trainer or provider is more than 10 minutes late, the session will be refunded. Punctuality is expected for all appointments.
18. Club Operations and Closures
The Club reserves the right to modify its hours of operation, including on public holidays. Temporary closures of all or part of the facility may occur for maintenance, repairs, or external events, with or without prior notice.
19. Legal Provisions
Member data is processed in accordance with our Privacy Notice. The Company reserves the right to assign its rights and obligations under this agreement to a third party without notice. No third party may enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999. In emergencies, Members are expected to follow evacuation protocols; staff are not obliged to search the premises.
20. Complaints Procedure
Members may submit complaints in writing via email or through the designated section in the Tonico app.
21. Communications
The Club will contact Members via email, SMS, or through app-based notifications for all operational and contractual matters.
22. Minors and Dependents
Except where explicitly allowed, children and dependents are not permitted to remain in the Club or access any facilities. Individuals aged 14–17 may train only under the supervision of an authorised personal trainer.
23. Interpretation and Amendments
These Terms & Conditions may be amended at the Club’s discretion. The most recent version shall supersede all prior versions and will be published on the Club's website and/or app. The Club retains the sole right to interpret and apply these Terms. Any verbal representations not confirmed in writing by the Club are non-binding.
