Membership Terms & Conditions

These Terms & Conditions govern membership at Tonico Health & Performance, operated by Nice and Solid Ltd (the “Company”). By entering the premises or purchasing a membership, each individual (“Member”) agrees to be bound by the following terms, as amended from time to time. Tonico Health & Performance (the “Gym”) is committed to providing an inclusive, respectful, and high-standard environment for all individuals, irrespective of race, gender, age, marital status, disability, religion, national origin, or sexual orientation.

1. Membership Structure and Eligibility
Membership is open to individuals aged 14 and over. Persons aged 14–17 may be admitted provided they train exclusively under the supervision of an adult guardian. Membership may be offered on a monthly, 3-month, or yearly basis, or via a single-entry day pass. Fees are as follows:
  • Monthly Membership: £275 per calendar month (rolling contract)
  • 3-Month Membership: £200 per month, billed monthly 
  • Yearly Membership: £150 per month, billed monthly
  • Day Pass: £50 per visit
Membership is non-refundable and non-transferable. The Gym reserves full discretion to approve or decline membership applications and to suspend or terminate memberships when deemed necessary.


2. Billing and Payment Terms
All recurring payments are collected every calendar month on the date the membership was first purchased, via authorised payment methods, including BACS direct debit, bank transfer, credit/debit card, or third-party processors (e.g., Stripe).

Tonico reserves the right to amend membership fees, joining fees, and any other charges at its sole discretion and at any time. The applicable price for any membership or service shall be the price in effect on the date of purchase. Any prices discussed, quoted, advertised, or otherwise communicated by Tonico prior to purchase are indicative only, subject to change, and do not constitute a binding offer.

Where changes affect existing memberships, notice will be provided to the member by email.


3. Default and Collection
Failure to remit payment may result in immediate suspension of access to the Gym. If an outstanding balance remains unpaid for more than 30 days, the full balance becomes immediately due. If payment is not made within 15 days following formal demand, the Gym reserves the right to terminate the membership and may refer the matter to a third-party collections agency.


4. Cancellation Policy
Cancellations must be submitted in writing via email to contact@tonicohp.co.uk, with a minimum of two (2) weeks' notice.
  • Monthly Membership: Members may cancel at any time, subject to the two (2) weeks' written notice requirement.
  • 3-Month Membership: Members are committed to a minimum term of three (3) months. Cancellation is not permitted before the 3-month period has elapsed. Thereafter, cancellations are subject to the standard two (2) weeks' written notice requirement.
  • Yearly Membership: Members are committed to a minimum term of twelve (12) months. Cancellation is not permitted before the 12-month period has elapsed. Thereafter, cancellations are subject to the standard two (2) weeks' written notice requirement.
Cancellations are effective only once confirmed by Tonico Health & Performance. No refunds are issued for partial months or for any unused membership period following cancellation. All memberships are based on a rolling cycle and will automatically renew, unless written notice is given to contact@tonicohp.co.uk that requests otherwise.


5. Membership Freezes
Membership freeze requests must be submitted in writing via email to contact@tonicohp.co.uk, with a minimum of two (2) weeks’ notice.

Membership freezes are available for a minimum period of one full calendar month and a maximum period of three (3) consecutive calendar months.
Membership fees remain payable until the freeze start date is confirmed by Tonico Health & Performance.


6. Discount Codes and Promotional Offers
From time to time, promotional or discount codes may be made available. Each discount code is subject to its own specific terms and conditions, including but not limited to validity period, eligibility requirements, and applicable services or memberships.

Discount codes cannot be applied retrospectively to purchases already completed and may not be combined with other offers unless explicitly stated.

7. Guest Privileges
Each Member is entitled to one complimentary guest pass per calendar month, which is non-cumulative. Guests must be over the age of 18 and must be accompanied by the hosting Member at all times. Guests are subject to all Gym rules and policies.


8. Access Control
Access to the Gym is granted exclusively via the dedicated mobile application. Entry is not permitted without scanning through the app.


9. Personal Training and Filming
Only authorised Tonico personal trainers may conduct training sessions within the Gym. Members may discreetly record themselves using mobile phones, provided no other individuals appear in the frame. The use of tripods or professional equipment is prohibited unless prior written consent has been obtained. Filming or photography is strictly prohibited in changing rooms and other private areas. Video calls are not permitted anywhere on Gym premises.


10. Conduct and Behaviour
All Members are expected to behave respectfully and in accordance with the Gym’s ethos. The following rules apply at all times:
  • No consumption of alcohol or illegal substances
  • No outside food; food is not permitted on the gym floor
  • Gym towels and toiletries must remain within the premises
  • Proper and clean training attire, including footwear, is required
  • Topless training or barefoot exercise is not permitted
  • Smoking and vaping are strictly prohibited
  • Sleeping or loitering is not allowed beyond permitted hours
Disruptive, abusive, or inappropriate behaviour may result in immediate expulsion and/or termination of membership.


11. Prohibited Items and Activities
The following are expressly forbidden within the Gym:
  • Weapons or hazardous objects
  • Controlled or illegal substances
  • Unauthorised commercial activity or services
  • Events, meet-ups, or group sessions without prior authorisation
  • Loud personal speakers or audio devices
  • Any action jeopardising the safety or well-being of others


12. Gym Floor Etiquette
Members must:
  • Wipe down equipment after use
  • Re-rack weights and accessories
  • Vacate the gym floor at least 20 minutes before closing time, if intending to shower


13. Lockers and Lost Property
Lockers are available for day use only; contents must be removed after each visit. Lockers are cleared each evening. Lost property is retained for up to one month. Perishable or wet items will be discarded after 48 hours.


14. CCTV and Security
Closed Circuit Television (CCTV) is in operation throughout the Gym for the safety and security of all members and staff, excluding changing rooms and private areas.


15. Referral Incentive
Members will receive one complimentary personal training consultation for each new referral who joins the Gym and remains a member for a minimum of two months. The following exclusions apply:
  • Returning members are not eligible as referrals
  • Members joining simultaneously may not refer one another


16. Refunds and Unused Sessions
No refunds will be issued for unused credits, sessions, or memberships following cancellation.


17. Health Declaration and Liability
All Members affirm that they are medically fit to undertake physical activity. If uncertain, they are encouraged to consult a medical professional prior to participation. The Gym disclaims liability for any injury or health issue arising from use of its facilities, except where caused by proven negligence. Members engage in all activities at their own risk. Pets are not permitted. Any accident or injury must be reported immediately to a staff member. An emergency contact must be provided upon joining.


18. Service Bookings
Cancellations for personal training or other services (e.g., massage) must be made with at least 24 hours’ notice. Failure to do so will result in full charges. If a trainer or provider is more than 10 minutes late, the session will be refunded. Punctuality is expected for all appointments.


19. Gym Operations and Closures
The Gym reserves the right to modify its hours of operation, including on public holidays. Temporary closures of all or part of the facility may occur for maintenance, repairs, or external events, with or without prior notice.


20. Legal Provisions
Member data is processed in accordance with our Privacy Notice. The Company reserves the right to assign its rights and obligations under this agreement to a third party without notice. No third party may enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999. In emergencies, Members are expected to follow evacuation protocols; staff are not obliged to search the premises.


21. Complaints Procedure
Members may submit complaints in writing via email or through the designated section in the Tonico app.


22. Communications
The Gym will contact Members via email, SMS, or through app-based notifications for all operational and contractual matters.


23. Minors and Dependents
Except where explicitly allowed, children and dependents are not permitted to remain in the Gym or access any facilities. Individuals aged 14–17 may train only under the supervision of an authorised personal trainer or adult (18 years old or older).


24. Interpretation and Amendments
These Terms & Conditions may be amended at the Gym’s discretion. The most recent version shall supersede all prior versions and will be published on the Gym's website and/or app. The Gym retains the sole right to interpret and apply these Terms. Any verbal representations not confirmed in writing by the Gym are non-binding.
